The essentials every lease needs
- Parties and property. The landlord, the tenant(s), and the exact rental address.
- Term. Fixed-term (e.g., 12 months) or month-to-month, with start and end dates.
- Rent. The amount, the due date, where/how it's paid, and any late fee.
- Security deposit. The amount, what it covers, and how/when it's returned.
- Occupants. Who's allowed to live there.
- Utilities. Who pays for what.
- Maintenance and repairs. Each side's responsibilities.
- Rules. Pets, smoking, noise, alterations, subletting.
- Entry. Notice the landlord must give before entering.
- Signatures.
Don't forget required disclosures
Landlords are often legally required to make certain disclosures depending on location — for example, lead-based paint disclosures for older properties in the U.S., and various state- or city-specific notices. These vary by jurisdiction, so check what applies where your property is.
Security deposit best practices
Many states cap how much deposit you can collect and set strict deadlines for returning it (often with an itemized list of deductions). Document the unit's condition at move-in and move-out with photos. A clear paper trail is your best protection in a deposit dispute.
Fixed-term vs. month-to-month
A fixed-term lease gives both sides stability for the term. A month-to-month arrangement offers flexibility but can be ended by either party with proper notice. Choose based on how much certainty you want — and note the required notice period for ending or changing the tenancy.
